As the Data Subject, we inform you of the terms and conditions under which BELLA VITA PERFUMES LIMITED (hereinafter "BellaVita" or the "Controller") will process the personal data that you provide to us and that are under our control and scope of reasonable decision, as well as the manner and means under which you may exercise your rights to privacy, control over your personal data and the protection thereof in accordance with the Law, the Regulations, the Guidelines and other applicable provisions.

Likewise, we inform you that during the processing of the personal data you provide to us, we will establish the necessary measures to comply with the principles of legality, quality, consent, information, purpose, loyalty, proportionality, and responsibility established by the Law and its Regulations. No automated decision-making, including profiling.

Data that will be subject to processing

Depending on your mode of contacting us and on which services you use, various data from different sources may be collected. Most of the data that we subject to processing is provided by you when you use our services or contact us. For the purposes set forth in this Privacy Notice, we may obtain the following personal data:

1.1.1. Personal Data

Personal data is any information concerning a natural or legal person, that identifies that person or that can be associated with an identifiable person. Information that allows us to distinguish you from other individuals. This data includes: name, title, autograph signature, electronic signature. This will also include information that allows us to stay in touch with you. This information includes your address, tax address, delivery address, email address, home phone number, or other contact phone number. We may also collect information related to your assets including credit card information to complete your membership or renew your membership. Details of your cards will be stored in accordance with the permissions granted by you and any other data of the same nature will be treated exclusively under this category.

1.1.2. Personal Data of Third Parties

In order to comply with its legal obligations to the Data Controller, BellaVita Luxury will process the personal identification and contact information of third parties that you provide to us as personal references. Therefore, you declare and accept that you have obtained the prior consent of said individuals for this purpose and undertake to inform them about the processing of their personal data and the content of this Privacy Notice.

1.1.3. Electronic Records and Information about your device

This information includes photographs, purchase information (in stores or in our online store), IP address used to access the Website, user preferences, browser type; activity on the site, image and/or voice recordings obtained through video surveillance systems in branches, among other records. Please be sure to provide us with complete and accurate information about said third parties. Additionally, this also includes location data, including general data about your location (e.g., your IP address) and, with your permission, the precise location information of your mobile device.

Please note that most mobile devices allow you to enable or disable the use of precise location services for all applications in your mobile device's settings menu. Computer and connection information, such as statistics about your use of our Services, information about traffic to and from websites, referral URLs, information about advertisements, your IP address, your access times including the pages viewed within our Services, your language preferences and your weblog information.

1.2. Purposes for the processing of your Data

We use your data within the framework of the strict Italian and European data protection law. We therefore generally only process your data for the purposes explained to you in this Privacy Notice or shared when we collect the data.

We process your personal data in order to provide you with our services. This processing is based on our legitimate interest in being able to technically provide you with the various functions of our services (Art. 6 (1) (f) GDPR). We also evaluate this data in order to measure the performance of our services, identify navigation problems, improve technical performance and user friendliness, estimate the required server performance and understand which content you are interested in. As part of providing our services, we also use your IP address to be able to show you the local offers at your request. To do this, we compare your IP address with our database of location areas, which we obtain from our service provider, and delete at short notice. Some purposes are necessary for which we process your data. This is to process your request and payment (including the evaluation of your payment method for fraud prevention purposes) and carry out the delivery of your order; to process your data for billing purposes; processing product returns; keeping a history of your transactions; administering loyalty, discount and rewards programs; carrying out clarifications and investigations; to communicate with you for different reasons related to your purchase, including aspects related to the delivery of your order, notifying you of product recalls or security aspects.

We also try to reach you through various advertising measures. With your consent, we measure the success of these measures. We also record whether an advertising measure has reached you and how you respond to it. In some cases, the compensation of our advertising partners also depends on the success of advertising measures. We record your behaviour in relation to the following advertising measures, among others. These are not necessary for the existence and fulfilment of the legal relationship that the Data Subject has with the Controller. However, they are complementary and important

1.3. Data Retention

We will retain your personal data for as long as a customer-supplier relationship exists, in order to properly manage it and send you relevant commercial information. If there is a prolonged period of inactivity, we will delete or anonymize your data when processing is no longer necessary, unless you request deletion earlier. Where data must be retained for legal obligations or to address potential liabilities, it will be securely stored in a "blocked" form, with access restricted.

We may also store your personal data for other purposes if or as long as the law allows us store it for particular purposes, including for defence against legal claims. For example, if claims are still possible under a contract, we retain the relevant data. When applying Art. 6 (1) (f) GDPR, your interests or fundamental rights and freedoms will limit the retention period and play a significant role in determining it.

1.4. Transfer of Personal Data

Bellavita Luxury may disclose or transfer your Personal Data at the request of a competent authority or in any other of the circumstances established in Art. 6 (1) (c) GDPR in conjunction with a specific legal basis in national law. In general, Bellavita Luxury may disclose or transfer your Personal Data without your consent, in all the exceptions provided for in applicable law.

In this regard, we may transfer your Personal Data to any parent, controlled, subsidiary, and/or affiliated company that operates under the same standards, processes, and/or internal policies as Bellavita Luxury. The following are, but are not limited to, the companies and purposes for which your Personal Data will be transferred to entities within the same Bellavita corporate group:

Third parties and entities receiving Personal Data assume the same obligations and/or responsibilities as Bellavita, in accordance with the provisions of this Privacy Notice.

Currently, we do not conduct international transfers of personal data. However, some of our IT or cloud providers may have servers located outside the European Economic Area (EEA). If such transfers occur, they will only be carried out when strictly necessary and with appropriate safeguards to ensure protection under the European Commission's standard data protection clauses which can be viewed here.

If data is transferred to third parties located outside the EU (e.g., the USA), the transfer will occur pursuant to the provisions of the GDPR. Specifically, the transfer will occur to a third country deemed in accordance with the decision adopted by the Court of Justice of the European Union or, for third countries not subject to an adequacy decision, the transfer will occur on the basis of the Standard Contractual Clauses, subject to verification that the third country guarantees an adequate level of protection for Personal Data.

1.5.1. Revocation of consent / objection to data processing

You can revoke your consent at any time with future effect using the contact address above. Furthermore, you have the right to object at any time to the processing of personal data concerning you based on a legitimate interest, for reasons related to your particular situation. In the event of an objection, we will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing that override the interests, rights, and freedoms of the data subject, or the processing serves to assert, exercise, or defend legal claims.

If we process personal data for direct marketing purposes, you have the right to object at any time to the processing of personal data for such advertising by contacting us at the above-mentioned address. This also applies to profiling insofar as it is associated with such direct marketing.

1.5.2. Revocation of consent / objection to data processing

You have the right to request confirmation from us as to whether personal data concerning you is being processed, and if so, which data is being processed, as well as the specific circumstances of the data processing. You can also request a copy of the personal data concerning you that is being processed.

1.5.3. Right to Rectification

You have the right to request that we immediately correct any inaccurate personal data concerning you. Taking into account the purposes of the processing, you also have the right to request that incomplete personal data be completed, including by means of a supplementary statement.

1.5.4. Right to Erasure

You have the right to request that we delete personal data concerning you immediately if and to the extent that the legal requirements for this are met.

1.5.5. Right to restriction of processing

You have the right under Art. 18 of the GDPR to request that we restrict processing if the legal requirements are met.

1.5.6. Right to data portability

In the case of processing based on consent or for the performance of a contract, to receive the personal data concerning you that you have provided to us in a structured, common and machine-readable format and to transmit this data to another controller without hindrance from us or to have the data transmitted directly to the other controller, where technically feasible.

1.6. Options to Limit the use or Disclosure of Your Personal Data

If you do not wish to receive Promotional Information, including our emails, you will: (a) be given the option to opt out of receiving this information both on the Website and when registering at our locations; (b) request to be removed from the lists by reaching out to through mail care@bellavitaluxury.it; (c) or; you can visit any of our locations and make your request in the Membership area.

1.7. Specific Privacy aspects on our website

1.7.1. We use data collection devices such as "cookies" on certain pages of the website to help analyze our web page flow, measure promotional effectiveness, and promote trust and safety. "Cookies" are small files placed on your hard drive that assist us in providing our services. We offer certain features that are only available through the use of a "cookie". We also use cookies to allow you to enter your password less frequently during a session. Cookies can also help us provide information that is targeted to your interests. The Bellavita Luxury website is not designed for persons under the age of 18 and we do not knowingly collect personally identifiable information from anyone under the age of 18. If you are under 18 years of age, you may browse Bellavita Luxury website, but please do not provide your personal information to us. For example, you cannot register. If we become aware that we have inadvertently received personal information from a visitor under the age of 18 on the website, we will delete the information from our records.

Insofar as we introduce new products or services, change Internet procedures or if Internet and IT security technology develops further, the "Privacy Policy" has to be updated.
